- GENERAL DESCRIPTION OF THE PROMOTION. The 2011 MONOPOLY Game at McDonald's consists of a $10,000 CASHstakes online pre-promotion sweepstakes (the "Pre-Promotion Sweepstakes"), an "In-Store Game" (the "In-Store Game") and, in Canada, a "Top Hat Toss" online game (the "Online Game") which includes a Nissan® Z™ Zweepstakes (the "Online Game Sweepstakes"). The In-Store Game is available at participating McDonald's restaurants in Canada, in the fifty (50) States of the United States of America and DC ("U.S.") and in Guam and Saipan. In these Official Rules, the U.S. and Guam and Saipan collectively are called the "U.S. Territory", and the U.S. Territory and Canada collectively are called the "Territory". The In-Store Game, the Online Game including the Online Game Sweepstakes and the Pre-Promotion Sweepstakes collectively are referred to in these Official Rules as the "Game". In these Official Rules, an eligible person who plays the Game is called a "Participant". Void where prohibited. As set out more fully below in these Official Rules, there are four (4) ways to play the Game:
- $10,000 Online Pre-Promotion Sweepstakes. Enter the Pre-Promotion Sweepstakes by using a FREE Code (a "FREE Code") to register for the Online Game. The "Pre-Promotion Sweepstakes" is planned to begin in Canada at 12:00:00 midnight on or about September 20, 2011 and to end at 11:59:59 p.m. on September 26, 2011 (the "Pre-Promotion Period");
- Play a MONOPOLY® "Instant Win" Game in the In-Store Game. The In-Store Game is planned to begin on September 27, 2011 and is scheduled to end in Canada on October 31, 2011 or while supplies remain of specially marked packaging items to which Game Pieces are affixed, as referred to in Rule 3A below. Note that the October 31, 2011 end date is subject to a corresponding extension if the Game runs long in restaurants; and
- Play a MONOPOLY "Collect & Win" Game in the In-Store Game. The In-Store Game is planned to begin on September 27, 2011 and is scheduled to end in Canada on October 31, 2011 or while supplies remain of specially marked packaging items to which Game Pieces are affixed, as referred to in Rule 3A below. Note that the October 31, 2011 end date is subject to a corresponding extension if the Game runs long in restaurants; and
- The Online Game. A computer with Internet access and a valid email address is required to play the Online Game. See Rule 5 for more details as to applicable computer technical requirements. A Participant in the Online Game should use the 11-digit unique alpha-numeric Code (a "Code") found on MONOPOLY Game Stamps (each a "Game Stamp"), but not found on "Instant Win" Game Stamps, to play the Online Game for a chance to win a prize (a "Prize"). In Canada, the Online Game is planned to begin at 12:00 midnight on or about September 27, 2011 and to end at 11:59:59 p.m. on November 5, 2011 (the "Online Game Period"); and includes the Online Game Sweepstakes in which a Nissan® Z™ 2012 Coupe Touring Model is available to be won in a random drawing. The random drawing in the Online Game Sweepstakes is planned to take place on or about November 14, 2011. A Participant can receive entries into the Online Game Sweepstakes as follows: with each valid Code (or FREE Code) which a Participant enters in the Online Game throughout the Online Game Period, that Participant will receive one (1) entry into the Online Game Sweepstakes. In addition, as applicable, each time a Participant completes five (5) Online game plays (each, an "Online Game Play") by ‘clicking' on a throw style and/ or enters a FREE Code, when the last of those five (5) Online Game Plays and/or FREE Code entries is actually received and recorded by the Game Computer, that Participant will receive five (5) additional entries (each, a "Bonus entry") into the Online Game Sweepstakes. Therefore, it is possible to achieve ten (10) entries and ten (10) Bonus entries into the Online Game Sweepstakes each Day of the Online Game Period. Available in the U.S. and Canada.
Note: If a Participant (who is not a Minor in his/her Province/Territory of residence) does not have immediate Internet access, the Participant may choose to inquire in his/her locality about where and how that access can be obtained. The Sponsor understands that many public libraries offer Internet access on terms adopted by each such library facility.
Note: Reference is made below, in applicable parts of these Official Rules, to email communications to be sent by the Sponsor to a Participant. Those email communications will be sent by the Sponsor to the Participant at the email address provided by the Participant at the time the Participant "registers" for the Pre-Promotion Sweepstakes or the Online Game (see Registration provisions and details in Rule 4 below). Participants should note that the Sponsor is not responsible if a Participant fails to or does not receive an email communication (including any redemption or other instructions in that email) from the Sponsor because the email address which that Participant provided at the time of Registration is or becomes erroneous, abandoned, discontinued, fraudulent or bogus, or if the Sponsor's email is intercepted by SPAM or other email filters, is misdirected or is not received for any reason (including without limitation the abandonment or discontinuance for any reason of the email address provided in the Participant's registration by the time the redemption instructions are sent). To help prevent an email message from being identified as SPAM a Participant can add Monopoly@PlayatMcD.ca and support11@playatmcd.ca to the "safe sender list" in his/her email application and should review that email application's help instructions for further information in that regard. The Sponsor's email will also be available for viewing in a potential Online Prize winner's My Account.
NOTE: INTERNET ACCESS AND A VALID EMAIL ADDRESS ARE REQUIRED TO PARTICIPATE IN ANY OF THE SWEEPSTAKES DESCRIBED ABOVE, TO PLAY THE ONLINE GAME, AND TO REDEEM CERTAIN IN-STORE PRIZES. SEE DETAILS IN THE APPLICABLE PORTION(S) OF THE RULES BELOW.
NOTE: BEFORE ANY CANADIAN RESIDENT WHO IS A POTENTIAL WINNER OF A PRIZE IN THE GAME CAN BE DECLARED A WINNER OF THE APPLICABLE PRIZE, HE/SHE FIRST MUST CORRECTLY ANSWER A SKILL-TESTING QUESTION (the "Skill-Testing Question") WITHOUT ASSISTANCE OF ANY KIND, WHETHER ELECTRONIC, MECHANICAL OR OTHER.
The Game computer (the "Game Computer") is the official time-keeping device for the Online Game. Except as otherwise specifically stated in these Official Rules, all times mentioned in these Official Rules shall be Canadian Eastern Time ("ET"). Whether that time is Eastern Standard Time or Eastern Daylight Savings Time will depend on any applicable "time change" dates that occur during the Game. A day (a "Day") comprises the 24-hour period starting at 12:00:00 midnight on a given calendar day and ending that calendar day at 11:59:59 p.m. The Game is being conducted in Canada in accordance with these Official Rules by McDonald's Restaurants of Canada Limited (the "Sponsor"). Persons who participate in the Game in Canada are subject to these Canadian Official Rules which are available at participating McDonald's restaurants in Canada and online at the website www.PlayatMcD.ca and www.jouezmcdo.ca (collectively and individually, the "Official Website"). Persons who participate in the Game in the U.S. Territory are subject to the U.S. Territory Official Rules. By participating in the Game in Canada, each Participant, and if the Participant is a Minor (a "Minor") in his/her Province/Territory of residence, that Minor's parent or legal guardian on behalf of the Minor, unconditionally accepts and agrees to comply with and abide by these Official Rules and by the decisions of the Sponsor in respect of the Game and the meaning and application of the Official Rules, which decisions shall be final and binding with respect to all aspects of the Game in Canada. The Sponsor in its sole and absolute discretion may engage various third parties to administer various aspects of the Game on its behalf. In these Official Rules, where the context permits or requires, the term "Sponsor" includes those third parties.
Note: A Code and Game Stamps are both defined in Rule 1D above and Game Pieces are defined in Rule 3 below. Codes, Game Stamps and Game Pieces are referred to from time to time in these Official Rules, individually as a "Game Material", and collectively as "Game Materials". The transfer of any Game Material by an ineligible person to a Participant is strictly prohibited, except that a Participant who is under the age of thirteen (13) can transfer a Game Stamp including the Code on that Game Stamp to his/her parent/legal guardian for the purpose of playing the Online Game.
- WHO IS ELIGIBLE TO PLAY. Subject to the provisions of these Official Rules, including without limitation the restrictions on eligibility set out below in this Rule 2: the In-Store Game is open only to any resident of the Territory and there is no age limit to play the In-Store Game; and the Pre-Promotion Sweepstakes is open to any resident of Canada and the U.S. who is thirteen (13) years of age or older on the date he/she registers for that sweepstakes; and the Online Game is open to any resident of Canada who is thirteen (13) years of age or older on the date he/she registers for the Online Game.
Persons in any of the following categories are NOT eligible to participate or win or use a Prize in the Game: (a) any person who, on or after April 1, 2011, was or is a director, officer, employee, agent or franchise owner of any one or more of the following: the Sponsor, McDonald's USA, LLC, or Hasbro Sales Corporation, Inc. (collectively, the "Game Entities"), or of any one or more of the Game Entities' respective divisions, parents, subsidiaries, franchisees or affiliated companies, advertising and promotion agencies, representatives, service agencies, or independent contractors; (b) any individual engaged in the development, production or distribution of materials for the Game; (c) any officer or director of Nissan North America, Inc. ("Nissan"), Microsoft Corporation, Unique Vacations, Limited ("Beaches Resorts"), Electronic Arts Inc. ("EA"), Wal-Mart Canada Corporation ("Walmart"), Hewlett-Packard Company, SpaFinder, Inc., Delta Air Lines, or MLT Inc. ("Delta Vacations") (collectively, the "Prize Partners") including each Prize Partner's respective parent company, subsidiary/subsidiaries, affiliated company/companies and service agencies, Nissan Canada Inc., Microsoft Canada Inc., Unique Vacations (Canada) Inc., Electronic Arts (EA) Canada Inc., or Hewlett-Packard (Canada) Co.; and (d) any person who is or purports to be an immediate family member (defined as spouse, dependent for federal income tax purposes, or step-, biological or adoptive mother, father, sister, brother, daughter or son) of, or who resides or is domiciled in the same household as, any person in any of the preceding categories. Note however that, except as provided above, employees of corporations named in Rule 2 (c) may participate in the Game but are not eligible to receive and may not redeem any Prize supplied or provided by the Prize Partner or by a sister or affiliated or parent company of a Prize Partner for whom they work. - HOW TO OBTAIN A GAME BOARD, HOW TO OBTAIN A GAME PIECE, FREE CODES AND TRANSFERS.
No McDonald's food or other purchase is necessary to play the Game. Making such a purchase will not improve a Participant's chances of winning a Prize in the Game.
A Participant can obtain an official Game board (a "Game Board") for the MONOPOLY Game (a) while supplies last, at any participating McDonald's restaurant in Canada, (b) online at the Official Website, until the Game ends, or (c) at the sole discretion of the Sponsor, in the one or more regional markets in Canada, via direct mail, or newspaper insert, or otherwise. A Game Board is not required to play the Game.
Each official MONOPOLY Game Piece (a "Game Piece") consists of two (2) Game stamps which are affixed to the Game Piece. Each Game Stamp contains a Code (the 11-digit alphanumeric Code referred to in Rule 1D above) which a Participant must use to play the Online Game. Game Pieces can be obtained as follows, while supplies last of specially marked packaging to which Game Pieces are affixed last. See Rule 3A for the list of those specially marked packaging.- How to Get a Game Piece In-Store. A Participant can get a Game Piece by visiting a participating McDonald's restaurant in Canada and purchasing one of the food items contained in specially marked packaging, while supplies last. One (1) Game Piece is attached to specially marked medium and large coffee cups, medium and large soft drink cups, Big Mac® cartons, Oatmeal cups, Biscuit wrappers (except Sausage Biscuit wrappers), Angus Burger cartons, 10-piece McNuggets® cartons, and large Fry boxes. Note: In Canada, when a Participant places an order for 20-piece McNuggets®, he/she will receive two 10-piece McNuggets® packages and each of those packages bears one Game Piece. As the Game progresses, some forms of the specially marked packaging referred to above may run out before others and may not be replenished.
- How to Get a Game Piece Without Purchase. A Participant can request a Game Piece, without buying a food item at a participating McDonald's restaurant, by mailing a postage-paid, self-addressed stamped envelope (a "request") bearing sufficient return postage and bearing on its exterior the Participant's return mailing address (first and last name, street address, city/town, Province/Territory, country, and postal code), legibly printed by the Participant manually in ink to: McDonald's 2011 MONOPOLY Game, Game Piece Request, P.O. Box 414, Saint John, New Brunswick, Canada, E2L 4L9. DO NOT SEND ANY POTENTIAL WINNING GAME MATERIAL(S), COMMENTS OR QUESTIONS TO THIS ADDRESS. Both the mailing and return addresses on the exterior envelope must be legibly hand-printed in ink and the return address on that exterior envelope MUST be the same as the address which appears on the enclosed self-addressed stamped envelope or the request will NOT be honoured. Envelopes with no return address on the outside will NOT be honoured. Requests that are sent in business reply envelopes, that utilize address labels or stickers, that are photocopied, hand-stamped, computer-generated or otherwise mechanically produced or reproduced, that are not addressed manually in ink, that fail in any way to comply with the requirements set out above in this sub-paragraph, or that are not mailed separately in separate outer envelopes will NOT be honoured. While supplies last, two (2) Game Pieces (each consisting of two (2) Game Stamps) will be mailed in response to each mail-in request that complies with these requirements. Mail-in requests must be received at the above address no later than November 4, 2011. Please note that the Online Game ends at 11:59:59 p.m. ET on November 5, 2011 and if Game Pieces sent by the Sponsor in relation to a mail-in request arrive after that time and date, the Code which appears on the applicable Game Stamps will no longer be able to be used in the Online Game. The Sponsor encourages Participants to send their mail-in requests with this deadline in mind.
- FREE CODES. No FREE Code is valid for an Online Game Play. The FREE Code (MCDFORREAL) is available during the Pre-Promotion Period. That FREE Code allows a Participant to register for the Pre-Promotion Sweepstakes and/or Online Game (see Rule 4 below respecting "registration") and gives that Participant: (a) one (1) Sweepstakes entry into the "Pre-Promotion Sweepstakes" taking place September 20, 2011 through September 26, 2011; or b) if entered September 27, 2011 through November 5, 2011, one (1) Sweepstakes entry into the Online Game Sweepstakes. Note however that if a Participant uses the FREE Code (MCDFORREAL) during the Pre-Promotion Period, he/she cannot use it again during the Game. Another FREE Code becomes available starting September 27. 2011. The FREE Code (MCDMONOPOLY) which becomes available starting September 27, 2011 is valid for the duration of the Online Game and gives the Participant one (1) entry into the Online Game Sweepstakes. Additional FREE Codes, or links to FREE Codes, may be included in Game communications authorized by the Sponsor that may appear or be sent from time to time during the Online Game Period, such as a FREE Code in a communication from a Prize Partner, but, when used by a Participant in the Online Game, any such FREE Code will only give the applicable Participant one (1) Sweepstakes entry into the Online Game Sweepstakes.
- TRANSFERS. The transfer of Game Stamps by an ineligible person to an eligible person is strictly prohibited except as follows: (i) an In-Store Participant who is under the age of thirteen (13) can transfer Game Stamps obtained In-Store or by mail to an eligible parent/legal guardian for the purpose of playing the Code Online; (ii) a Participant who is under the age of majority in his/her Province/Territory of residence must transfer Game Stamps to his/her parent/legal guardian to redeem a Prize; (iii) if a Participant (who is not a minor) does not have immediate Internet access, the Participant may: (a) choose to inquire in his/her locality about where and how that access can be obtained (e.g., a public library), or (b) ask a trusted person with Internet access and a valid email address who is at least thirteen (13) or older to play or redeem the potential winning Game Stamp(s) on Participant's behalf. Such person must provide the Participant's name and address information for a Prize claim. In such a case, the Prize will then be sent to the Participant at the address provided during the Prize claim process. Neither the Sponsor, Prize Partners nor any other person or entity shall be liable or responsible for any failure on the part of a Participant to correctly follow in full the redemption instructions and procedures contained in or provided pursuant to these Official Rules; and (iv) a Participant who is the potential winner of a Prize may not transfer the Prize or the related potential winning "Instant Win" Game Stamp, or potential Winning Combination (defined below), as the case may be, unless authorized in writing by the redemption center (the "Redemption Center") before the transfer is made. Such authorization may be granted or withheld in the Sponsor's sole discretion. A Participant must make any request for such authorization in writing and must sign and return the request to the Redemption Center in the Pre-paid envelope provided to the Participant by the Redemption Center for the return to the Redemption Center of the Prize Claim Materials (see definition of Prize Claim Materials in Rule 7 below).
- HOW TO ENTER THE PRE-PROMOTION SWEEPSTAKES, THE PRE-PROMOTION DRAWING, AND HOW TO PLAY THE IN-STORE GAME. Game Stamps: To play the In-Store Game, first obtain a Game Piece (see Rule 3 above). Then carefully peel each Game Stamp from its backing on the Game Piece, or from the specially marked packaging to which the Game Piece is affixed, to determine if a Game Stamp is an "instant winning" Game Stamp (an ‘"Instant Win" Game Stamp') which potentially may win a Prize, or is a Game Stamp (a ‘"Collect & Win" Game Stamp') which is part of a potential Winning Combination (defined below) in the In-Store Game. See Rule 4B and 4C below for more details about the In-Store Game.
A Participant also can play the Online Game, as set out more fully below, by visiting the Official Website and entering the Code found on each Game Stamp (except in the case of "Instant Win" Game Stamps which have a ‘code' [but not an 11-digit Code] which is used in the verification and redemption process involved in claiming a Prize). See Rule 5 below for more details about the Online Game.
Note: It is possible for a Participant to win three (3) Prizes using the SAME Game Stamp, namely: (1) a Food Prize, an "Instant Win" Prize or a "Collect & Win" Prize via the Game Stamp; (2) an "Online Prize" using the Code found on the Game Stamp in the Online Game; and (3) a Sweepstakes Prize if the Participant's entry in the Online Game Sweepstakes (see Rule 5C below) is selected as the potential winning entry in the Online Game Sweepstakes.- Pre-Promotion Sweepstakes. To participate in the Pre-Promotion Sweepstakes a Participant must have the FREE Code which is offered during the Pre-Promotion Period and can be obtained (a) at the Official Website, or (b) in various Game communications, or (c) simply use the FREE Code "MCDFORREAL". The Pre-Promotion Sweepstakes is available in Canada and the U.S. and is subject to all requirements, terms and conditions of these Official Rules.
When a Participant has obtained that FREE Code, he/she should access the Official Website during the Pre-Promotion Period, enter the FREE Code on the opening page by typing the FREE Code into the Code input field exactly as it appears on the Participant's FREE Code material or it will not be accepted, and then click "GO!" which will take the Participant to the registration page of the Official Website. The Participant should complete the registration form (the "registration form") which appears on the registration page. The Participant also should read the Official Rules including without limitation the eligibility provision (Rule 2). The Participant will be required to: fill in his/her first and last name, fill in his/her valid personal email address, confirm that email address, create a password (and confirm that password), ‘click' a box confirming that he/she is thirteen (13) years of age or older, fill in his/her daytime telephone number and complete residential mailing address including city/town, Province/territory and postal code which must be current in all respects, then ‘click' the applicable box to state that he/she has read, understands and agrees to the provisions of the Official Rules and that he/she has read the eligibility requirements to play the Online Game and that he/she is eligible. If a Participant wishes to receive communications from McDonald's, or Walmart, or both, he/she simply opts-in by ‘clicking' on the applicable box(es). Whether or not a Participant elects to receive communications from the Sponsor will have no effect upon his/her ability to play or win a Prize. After the Participant completes the registration form, he/she then must enter accurately the alpha-numeric security verification code ("Security Code"). Once a Participant has completed the registration process just described, the Participant should ‘click' "REGISTER" in order to submit his/her entry into the Pre-Promotion Sweepstakes. Completion of the preceding steps is referred to in these Official Rules as "Registration".
Note: Once a Participant is registered, when the Participant returns to play the Online Game, he/she needs only to input the email address and password the Participant used on his/her registration form, then ‘click' to "SIGN IN", then input a valid Code or FREE Code and ‘click' "GO!". If a Participant is using a public computer to register, the Participant should be sure to sign off the computer when he/she is finished.
Once a Participant has completed Registration, and when the Participant's FREE Code submission and online Registration are received and recorded by the Game Computer during the Pre-Promotion Period, the Participant will see a message screen which confirms that an entry into the Pre-Promotion Sweepstakes has been received and recorded by the Game Computer. Following Registration, the Participant will receive an email confirming his/her Registration.
It is planned that on or about October 3, 2011, the Sponsor will carry out a random computer selection (the "Pre-Promotion Drawing") in which one (1) "Initial Selected Entry" and ten (10) "Backup Entries" will be selected from among all entries which comply with these Official Rules and which have been received and recorded by the Game Computer during the Pre-Promotion Period. See Rule 5D for further details respecting the "Initial Selected Entry" and "Backup Entries".
Provided the Participant who submitted the Initial Selected Entry (or, if applicable, the Participant who submitted a Backup Entry) complies with the requirements of these Official Rules (including without limitation, if he/she is resident in Canada, correctly answering, without any assistance whether mechanical or electronic or other, a mathematical Skill-Testing Question which will be administered over the telephone at a mutually agreed upon time), that Participant, subject to the provisions and requirements of these Official Rules, will be eligible to receive a cheque for $10,000.
There is a limit of one "Pre-Promotion Sweepstakes" entry per Participant, regardless of any guise or method a Participant may use or attempt to use to carry out or submit or record or have recorded multiple entries. There also is a limit of one Pre-Promotion Sweepstakes entry per email address (therefore, if two people wish to enter, they MUST have separate email addresses). If the Sponsor finds that either of these limits has been exceeded, any Participant who is involved in that conduct will be disqualified from the "Pre-Promotion Sweepstakes", and all entries submitted by that Participant for the entire Pre-Promotion Period also will be disqualified. See Rule 5E ("Conditions/Limitations Applicable to the Online Portions of the Game") below for important information concerning conditions and limitations applicable to Registration for Online Portions of the Game including Registration in the Pre-Promotion Sweepstakes.
The chances of winning the Prize in the Pre-Promotion Sweepstakes depend on the number of entries made in compliance with these Official Rules and received and recorded by the Game Computer during the Pre-Promotion Period.
The Sponsor will attempt to actually contact and speak to the Participant who submitted the Initial Selected Entry by telephone within two (2) business Days after the date of the Pre-Promotion Drawing, AND the Sponsor will send that Participant (via overnight courier delivery and email to the addresses the Participant provided on his/her registration form), the required Prize Claim Document (the "Prize Claim Document") and instructions for the Participant to contact the Redemption Center to schedule a time for the Sponsor to administer the required Skill-Testing Question to that Participant. That time for administering the Skill-Testing Question must occur within eight (8) business days from the date the Sponsor sends the Participant the Prize Claim Document referred to above.
In addition to being required to correctly answer the Skill-Testing Question, without any assistance whether mechanical or electronic or other, and prior to the applicable Prize being awarded to the selected Participant, that Participant will be required to complete and return to the Redemption Center, in a pre-paid envelope which the Redemption Center will provide to him/her, the Prize Claim Document which contains, among other things, a declaration of eligibility, a liability release and a publicity release. Subject to these Official Rules, when the Redemption Center receives the completed Prize Claim Document, the Redemption Center will begin the verification process found in Rule 9. The Redemption Center will notify the selected Participant whether he/she is or is not a verified winner in approximately two (2) weeks from the date the completed Prize Claim Document and any other required materials are actually received by the Redemption Center. If the selected Participant is verified as a Prize winner, the Redemption Center will award the Prize. If the selected Participant is disqualified for any reason (including without limitation failing to correctly answer the Skill-Testing Question) the Sponsor will proceed to conduct the process described in paragraph "D" of Rule 5, to attempt to award the applicable Prize.
If the selected Participant is a Canadian resident and is a Minor, his/her parent or legal guardian will be required to sign the Prize Claim Document on his/her behalf (please refer to Note in Rule 7 below).
The winner of the applicable Prize may not transfer that Prize without complying with all of the requirements set out in Rule 3D "Transfers".
The Skill-Testing Question must be correctly answered and the original, fully completed and executed Prize Claim Document must actually be received by the Redemption Center within eight (8) business Days after the date the Prize Claim Document is sent to the applicable Participant, failing which the selected Participant will be disqualified, will forfeit the applicable Prize and will have no claim against the Sponsor or any other person respecting the forfeited Prize or the Game and the Sponsor will proceed to conduct the process, described in paragraph "D" of Rule 5, to attempt to award the applicable Prize. - In-Store Game: MONOPOLY "Instant Win". If an "Instant Win" Game Stamp describes a Prize identified in these Official Rules (See Rule 6B), the Participant who possesses that Game Stamp is the potential winner of that Prize, subject to verification of the potential winning "Instant Win" Game Stamp and the Participant's compliance with these Official Rules, including correctly answering the Skill-Testing Question, without any assistance whether mechanical or electronic or other, if that selected Participant is a Canadian resident. (See Rule 7 "How To Redeem/Claim A Prize/Deadlines".)
- In-Store Game: MONOPOLY "Collect & Win". "Collect & Win" Game Stamps describe the name of a MONOPOLY® street property or railroad that corresponds to a street property or railroad on the Game Board. A Participant must match the property name and stamp number which is identified on the "Collect & Win" Game Stamp with the corresponding property name and stamp number shown on the Game Board. The combination of "Collect & Win" Game Stamps which must be collected in order to form a potential winning combination (a "Winning Combination") can be found on the Game Board, on individual "Collect & Win" Game Stamps, and in Rule 6C of these Official Rules. If a Participant collects all of the "Collect & Win" Game Stamps required to complete a property set for a Winning Combination, that Participant is the potential winner of the Prize indicated on the applicable "Collect & Win" Game Stamps, subject to verification of the "Collect & Win" Game Stamps and the Participant's compliance with these Official Rules, including correctly answering the Skill-Testing Question, without any assistance whether mechanical or electronic or other, if that selected Participant is a Canadian resident. (See Rule 7 "How To Redeem/Claim A Prize/Deadlines".)
- Pre-Promotion Sweepstakes. To participate in the Pre-Promotion Sweepstakes a Participant must have the FREE Code which is offered during the Pre-Promotion Period and can be obtained (a) at the Official Website, or (b) in various Game communications, or (c) simply use the FREE Code "MCDFORREAL". The Pre-Promotion Sweepstakes is available in Canada and the U.S. and is subject to all requirements, terms and conditions of these Official Rules.
- HOW TO PLAY THE ONLINE GAME. A valid Code (or FREE Code), a valid email address, and a computer with Internet access and the following minimum technical requirements are required to participate in the Online Game.
- Computer System Requirements.
Minimum Adobe Flash version: 10.0 JavaScript must be enabled on the browser.
Browsers: PC: Internet Explorer 7, 8, 9; Google Chrome 10, 11, 12, or Firefox 3.6 or 4.
Mac: Firefox 3.6 or 4, or Safari 4 or 5.
The Game is optimized for use with a 1024 x 768 screen resolution. Using a screen resolution lower than 800 x 600 may result in a Participant not being able to play the Online Game.- Note respecting Official Website and Online Game Access: If a Participant does not have immediate Internet access, the Participant may choose to inquire in his/her locality about where and how that access can be obtained. The Sponsor understands that many public libraries in Canada do offer Internet access on terms adopted by each such library facility.
- My Account. When a Participant registers for the Online Game, an account called "My Account" ("My Account") will be created for him/her. The My Account will contain the Participant's online play activity record including, but not limited to, a list of the Codes that he/she has played. A Participant can access his/her "My Account" by clicking on the "SIGN IN" link on the Official Website landing page and inputting the Participant's email address and password. While the Sponsor will make reasonable efforts to record, maintain and keep current the information in a Participant's "My Account", due to technical or other problems, errors, omissions or failures, that information may not always be current, accurate and/or complete, in which case, the Sponsor accepts no responsibility or liability for any resulting misinformation or delay in displaying information.
- Passwords. A Participant is solely responsible for the security of his/her email address and password. Each Participant should take precautions to keep his/her password private to prevent unauthorized use. Neither the Sponsor nor any person, firm or corporation involved in or related to the Game or its conduct is responsible for any losses, damages or adverse consequences any Participant may suffer due to careless or unauthorized use of a password – that is each Participant's responsibility alone.
- Online Game Play. The Online Game is played at the Official Website where a Participant will need a valid Code found on MONOPOLY Game Stamps (except "Instant Win" Game Stamps), or an unused FREE Code (a FREE Code is valid for an Online Game Sweepstakes entry, but not for an Online Game Play), to participate. Once at the Official Website, the Participant should enter the Code exactly as shown on the Game Stamp (or should enter an unused FREE Code) and click on "GO!" If the Code entered is not valid (or the FREE Code has been used), a message will appear stating the Code is not valid. If the Code is valid, the Participant will be taken to a log-in/registration page.
If the Participant has already registered for the Online Game, then he/she will only need to enter his/her valid password and email address at the SIGN IN/registration page and click "SIGN IN" to be taken to the Top Hat Toss How to Play page. If the Participant has not already registered for the Online Game, he/she must complete the registration form at the SIGN IN/registration page (see Rule 4A above for details about how to register) and click "REGISTER" to be taken to the Top Hat Toss How to Play page.
When the Participant is taken to the Top Hat Toss How to Play page, he/she should press "PLAY NOW" to play the Online Game, where he/she can receive one (1) Game Play and one (1) Online Game Sweepstakes entry. To play the Top Hat Toss Game, the Participant should select and ‘click' on one (1) of the three (3) card throw styles (All-Star, Vegas or Ultimate) shown. When the Participant ‘clicks' on his/her selected throw style, "Mr. MONOPOLY" will attempt to throw the Chance card into a top hat. The throw style which a Participant selects will have no effect on whether or not the Online Game Play is a potential winner.
If, at the end of the throw, the Chance Card does NOT land inside the top hat, the Participant is not a potential Prize winner and the on-screen message will inform him/her of that fact. If, at the end of the throw, the Chance Card lands inside the top hat, an on-screen message will inform the Participant that he/she is a potential Prize winner and will reveal the applicable Prize. All Prizes are time seeded (see Rule 6D below for details).
If the on-screen message reveals that the Participant IS the potential winner of a Prize listed in Rule 6D of these Official Rules, then the Participant can begin the Prize claim process immediately by clicking on "BEGIN REDEMPTION PROCESS", or the Participant can elect to begin the Prize claim process later, subject to applicable deadlines set out in these Official Rules, by following the instructions contained in an email which the Participant will receive from the Sponsor. That email contains instructions which the Participant must follow to claim the applicable Prize and will be sent to the email address which the Participant provided in his/her registration form.
Even if the on-screen message informs the Participant that he/she is not a potential winner of a Prize, he/she nonetheless will receive one (1) entry into the Online Game Sweepstakes.
If a Participant wishes to continue playing the Online Game for a chance to win an online Prize, he/she will need to enter another valid Code.
IMPORTANT: THERE IS A LIMIT OF TEN (10) ONLINE GAME PLAYS PER DAY. FREE CODES DO NOT COUNT IN DAILY PLAY LIMITS.
NOTE: If there is a power or a computer-related interruption after a Code has been entered and submitted and the applicable Participant has logged into the Official Website, but before a card throwing style is ‘clicked', it is possible that the Code may have been forfeited. When power is restored or the interruption corrected, sign in to the Official Website and try to enter the applicable Code to determine if that Code has been accepted by the Game Computer before the interruption occurred. If the Code was accepted by the Game Computer, then proceed to play the Online Game by selecting a card throwing style, and receive one (1) Online Game Play and one (1) Online Game Sweepstakes entry. If it was not accepted, an on-screen message will indicate that the Code is null and void and cannot be used in the Online Game. The Sponsor is not responsible for any Codes lost due to power or computer-related interruption of a Game play. - The Online Game Sweepstakes. As stated above, when a Participant has completed his/her Registration and enters a Code (or a FREE Code), and that Code or FREE Code submission is received and recorded by the Game Computer during the Online Game Period, the Participant will have one (1) entry into the Online Game Sweepstakes recorded on his/her behalf.
- Bonus Entries into the Online Game Sweepstakes: A "Sweeps-O-Meter" will keep track of a Participant's Online Game Plays. Each time a Participant completes five (5) Online Game Plays (including, if applicable, a FREE Code entry/entries), he/she will receive an additional five (5) Bonus entries into the Online Game Sweepstakes. For example, a Participant who completes five (5) Online Game Plays (including, if applicable, a FREE Code entry/entries), in addition to receiving one (1) entry into the Online Game Sweepstakes for each of those Online Game Plays (including, if applicable, a FREE Code entry/entries), will receive five (5) Bonus entries for a total of ten (10) Online Game Sweepstakes entries. Bonus entries will only be awarded each time a Participant completes five (5) Online Game Plays (including, if applicable, a FREE Code entry/entries).
- The Online Game Sweepstakes ‘Draw' and Chances of Winning: It is planned that on or about November 14, 2011, the Sponsor will carry out a random computer selection in which one (1) "Initial Selected Entry" and ten (10) "Backup Entries" will be selected from among all entries which comply with these Official Rules and have been received and recorded by the Game Computer between September 27, 2011 and November 5, 2011 inclusive. See Rule 5D below for details respecting the "Initial Selected Entry" and "Backup Entries".
Subject to complying with the provisions of these Official Rules (including in the case of a Canadian Participant, first having correctly answered a Skill-Testing Question, without any assistance whether mechanical or electronic or other), the Participant whose entry is selected in the Online Game Sweepstakes draw will receive as a Prize a 2012 Nissan® Z™ Coupe Touring model: Approximate Retail Value ("ARV"), excluding freight, $42,350**.
The chances of winning a Prize in the Online Game Sweepstakes will depend upon the number of eligible entries into that sweepstakes which have been received and recorded by the Game Computer during the Online Game Period.
- IMPORTANT NOTE RE SWEEPSTAKES DRAWS, "INITIAL SELECTED ENTRIES" AND "BACKUP ENTRIES": In the case of each of the Pre-Promotion Sweepstakes and the Online Game Sweepstakes, at the time a potential winning Entry is selected (the "Initial Selected Entry"), the Sponsor also will carry out a computerized random selection of ten (10) additional Entries (each, a "Backup Entry"). If for any reason, the Participant who submitted the Initial Selected Entry in any sweepstakes is not verified and declared a winner of the applicable Prize, the Sponsor will proceed with the applicable verification process with the Participant who submitted the first Backup Entry selected as described above. The Sponsor will continue this process, if and as required and in sequence, with other Participants who submitted subsequent selected backup Entries until a Participant is verified and declared a winner of the applicable Prize in accordance with the provisions of these Official Rules. If, in a particular Sweepstakes, none of the Participants who submitted the Initial Selected Entry and backup Entries is verified and declared a winner of the applicable Prize, that Sweepstakes Prize will be forfeited and will not be awarded in the Game.
- Conditions/Limitations Applicable to the Online Portions of the Game. There is a limit, if applicable, of one Pre-Promotion Sweepstakes entry, per Participant, and of one Pre-Promotion Sweepstakes entry, per email address (therefore, if two people wish to enter, they MUST have separate email addresses), regardless of any guise or method a Participant may use or attempt to use to carry out or submit or record or have recorded multiple entries.
There is a limit of one Registration per Participant, regardless of any guise or method a Participant may use or attempt to use to achieve multiple Registrations and Entries. There also is a limit of one Registration per email address (therefore, if two people wish to enter, they MUST have separate email addresses). If the Sponsor finds that any Participant has attempted or is attempting to secure, or has secured, more than one Registration in contravention of the limits just described, whether by using different names, addresses, email addresses, or by using or being involved in any device or artifice or scheme or plan to circumvent or contravene these limits or the Official Rules, or in any other manner or for any other reason, that Participant will be disqualified from participating in the Online Game and ALL of that Participant's online plays including potential winning or winning plays will be forfeited and that Participant will be prevented from playing the Game and/or winning Prizes.
Note: If it becomes necessary for a Participant to change his/her email address after completing Registration, then he/she must go to "CONTACT US" on the "HELP PAGE" and request a change. The change will take approximately five (5) to seven (7) business days before the Participant can use the new email address. There is a limit one (1) email change per Participant during the Online Game Period.
As stated above, there is a limit of ten (10) Game Stamp Code entries per Day (FREE Codes do not count in daily play limits).

The time that a Participant ‘clicks' on his/her selected card throw style to execute an Online Game Play which is received and recorded by the Game Computer will determine whether that Participant is a potential winner of a Prize. The first Participant to execute a successful Online Game Play that is received and recorded by the Game Computer on or after a Winning Time is the potential winner of the Prize which has been randomly seeded to be available to be won at that Winning Time. If no Online Game Play occurs at a Winning Time, that Prize will remain available to be won by the next Participant who successfully executes an Online Game Play that is received and recorded by the Game Computer. If, however, the Winning Time occurs for another higher value Prize before a Participant executes the next successful Online Game Play, that Participant who submits the next successful Online Game Play will be the potential winner of the "higher" value Prize and the original remaining Prize will remain available until the next Participant submits a valid Online Game Play that is received and recorded by the Game Computer. - The Online Game Sweepstakes Prize, Draw and Notification:
- "Online Game Sweepstakes". One (1) Prize is available to be won in the Online Game Sweepstakes in the United States of America and Canada combined. If the Participant who submitted the verified winning entry is a Canadian resident, that Participant will receive a 2012 Nissan® Z™, ARV: $42,350**.
- Potential Winner Notification. The Sponsor will attempt to actually contact and speak to the Participant who submitted the Initial Selected Entry by telephone within two (2) business Days after the date of the Online Sweepstakes Drawing, AND the Sponsor will send that Participant (via overnight courier delivery and email to the addresses the Participant provided on his/her registration form), the required Prize Claim Document together with instructions for the Participant to contact the Redemption Center to schedule a time for the Sponsor to administer the required Skill-Testing Question to that Participant. That time for administering the Skill-Testing Question must occur within eight (8) business Days from the date the Sponsor sends the Participant the Prize Claim Document referred to above.
In addition to being required to correctly answer the Skill-Testing Question, without any assistance whether mechanical or electronic or other, and prior to the applicable Prize being awarded to the selected Participant, that Participant will be required to complete and return to the Redemption Center, in a pre-paid envelope which the Redemption Center will provide to him/her, the Prize Claim Document which contains, among other things, a declaration of eligibility, a liability release and a publicity release, together with any additional required documents. Upon receipt of the completed Prize Claim Document (and any additional required documents), the Redemption Center will begin the verification process found in Rule 9. The Redemption Center will notify the selected Participant if he/she is or is not a verified winner in approximately two (2) weeks from the date the Prize Claim Document and any other required materials are actually received by the Redemption Center. If the selected Participant is verified as a Prize winner, the Redemption Center will award the Prize. If the selected Participant is disqualified for any reason (including, without limitation, for failing to correctly answer the Skill-Testing Question) the Sponsor will proceed to conduct the process described in paragraph "D" of Rule 5, to attempt to award the applicable Prize.
If the selected Participant is a Canadian resident and is a Minor, his/her parent or legal guardian will be required to sign the Prize Claim Document on his/her behalf (please refer to Note in Rule 7 below).
The winner of the applicable Prize may not transfer that Prize without complying with all of the requirements set out in Rule 3D "Transfers".
The Skill-Testing Question must be correctly answered and an original, completed and fully executed Prize Claim Document must actually be received by the Redemption Center within eight (8) business Days after the date the Prize Claim Document is sent to the applicable Participant, failing which the selected Participant will be disqualified, will forfeit the applicable Prize and will have no claim against the Sponsor or any other person respecting the forfeited Prize or the Game and the Sponsor will proceed to conduct the process, described in paragraph "D" of Rule 5, to attempt to award the applicable Prize.
- Food Prizes. There are approximately 14,516,106* "Instant Win" Prizes (each, an '"Instant Win" Prize') of which approximately 13,413,574* are Food Prizes (each a "Food Prize") available to be won in Canada in the Game. The approximate quantities of specified Food Prizes available to be won only in Canada, the Odds of winning a specified Food Prize, as of the outset of the Game, and the ARVs of each specified Food Prize, are described below.
- HOW TO REDEEM/CLAIM A PRIZE/DEADLINES/DETAILS.
Note: Any Prize claimant (except Food Prize claimants) must be of the age of majority in his/her Province/Territory of residence, or must be the parent/legal guardian of the Minor potential Prize winner, in order to claim a Prize.- Food Prizes. Potential winning "Instant Win" Game Stamps for McDonald's food items that are Food Prizes in the Game may be redeemed only in-store (not at or through a Drive-Thru) at any participating McDonald's restaurant in Canada. A Participant should inform a McDonald's restaurant counter person that he/she wishes to redeem a potential winning "Instant Win" Game Stamp for a Food Prize. The Participant should present the potential winning "Instant Win" Game Stamp for the Food Prize for redemption before the food order is placed. The counter person will provide the Participant with a restaurant level food Prize redemption form (a "Food Redemption Form"), which contains a Skill-Testing Question. The Participant then should complete the Food Redemption Form legibly, and in full, including his/her signature and correct answer to the Skill-Testing Question (arrived at independently by the Participant without assistance of any kind, whether mechanical, electronic or other), which is printed on the Food Redemption Form. Then, the Participant should present the following to the counter person for verification and redemption for the applicable Food Prize: his/her completed Food Redemption Form (including his/her correct answer to the Skill-Testing Question) and his/her potential winning "Instant Win" Game Stamp, which he/she must affix to the Food Redemption Form in the space indicated, with his/her initials signed in ink across the face of his/her potential winning "Instant Win" Game Stamp. "Instant Win" Game Stamps for Food Prizes may be redeemed only during the hours the menu item is served and only on a future visit. "Instant Win" Game Stamps for Food Prizes are not valid in combination with any other offer or discount. Only one (1) Food Prize redemption is permitted per Participant per visit. All visits to the same restaurant within a two-hour period are deemed to constitute a single visit. Participating McDonald's restaurants reserve the right to substitute a menu item of equivalent or greater retail value for the Food Prize specified. Some participating McDonald's restaurants may run out of their supply of specially marked packaging containing Game Pieces before the Game officially ends, but they will continue to honour winning Game Stamps for Food Prizes that are redeemed in accordance with these Official Rules. The deadline for claiming a Food Prize is November 14, 2011.
IMPORTANT NOTES: Participants should play the Code at the Website before redeeming a Game Stamp for a Food Prize because that Game Stamp (including the Code which appears on it) must be surrendered at the time of the Food Prize redemption. - Notes about Prize Claim Materials and Related Matters.
- The "Prize Claim Materials" which are required to be submitted to support Prize claims and redemptions differ by the value of the Prize being claimed and redeemed. The Participant will be advised of the Prize Claim Materials required for a Prize when the Participant begins the process of redeeming and claiming that Prize, for example but not limited to, (a) in the case of certain In-Store Game Prizes calling the toll free number which appears on a Game Stamp or claiming and redeeming a Prize Online, and (b) for Online Game Prizes by clicking to claim a Prize where indicated in potential winning messages on screen and in confirming emails.
- When Prize Claim Materials require the submission of Game Stamps, the Game Stamps must be original and must comply with the provisions of these Official Rules.
- When Prize Claim Materials require a Prize Claim Document, the Prize Claim Document may be accompanied by a form for tax filing purposes and such other documents as may be determined by Sponsor in its sole discretion. Further, in the case of Prizes which include trips, the potential Prize winner will receive guest releases that he/she must have each of his/her guests properly complete and sign. The guest release will include a liability and publicity release which must be executed by each guest. The potential Prize winner must return to the Sponsor an original, properly completed and signed guest release for each guest as a part of the documents required by the Sponsor in accordance with instructions which the Sponsor will provide to that potential Prize winner.
- Monetary Prizes: The winner of a monetary Prize should follow the instructions in (Rule 7D or Rule 7F based on the amount of the Prize being claimed). Subject to these Official Rules, any monetary Prize which is won in Canada will be awarded in the form of a cheque in Canadian dollars in the amount of the Prize. The $1,000,000 Prize will be awarded as a $50,000 cheque each year for twenty (20) years, without interest. All ARVs and dollar values in these Official Rules are stated in Canadian Dollars. A Prize is deemed won in the Prize winner's country of residence.
- Claiming Prizes Valued Under $600: In-Store Prize: A potential winner (or his/her parent or legal guardian if potential winner is an eligible minor), must follow the instructions on the Game Stamp to begin the Prize claim process by November 21, 2011. A potential winner may use the URL: www.iwonatmcd.ca (the "Online Redemption Site") or, if a toll-free number appears on the Game Stamp, use that toll-free number to obtain the instructions necessary to claim a Prize. The potential winner should retain the potential winning Game Stamp(s) as the potential winner may need to submit those Game Stamp(s) with his/her claim. If a potential Prize winner elects to complete the Prize claim process via mail, he/she will receive instructions from The Redemption Center to mail the potential winning "Instant Win" or "Collect & Win" Game Stamp(s) along with a piece of paper on which he/she provides his/her complete name, mailing address, confirmation of having reached the age of majority in his/her Province/territory of residence, a daytime and evening telephone number and his/her email address (if available), and his/her answer to the Skill-Testing Question which was provided during the information call when the potential Prize winner called the toll-free number. Note: If the potential winner is a minor in his/her Province/territory of residence, the piece of paper must set out the information just described for that parent or legal guardian. Prize Claim Materials, including the potential Prize winner's answer to the Skill-Testing Question must be mailed to The Redemption Center at an address that will be provided to the potential winner during the toll-free call. All properly executed Prize Claim Documents and any Game Stamps must be received for actual receipt by the Redemption Center by December 5, 2011. Online Prize Claims: Unless otherwise specified in these Official Rules, a potential winner (or his/her parent or legal guardian if potential winner is an eligible minor), must follow the instructions and begin the Prize claim process by November 21, 2011. Upon receiving a potential winning message, a potential Prize winner can click "BEGIN REDEMPTION PROCESS" (or if the potential Prize winner wishes to claim his/her Prize later, he/she can follow the instructions in the Prize email which will be sent by the Sponsor to him/her). If a potential Prize winner elects to begin the claim process immediately, a Prize claim form, which will including a Skill Testing Question, can be completed online at the Online Redemption Site. In the case of a SpaWish® Prize, the confirmed winner must claim the Prize by November 30, 2011 and will be given a code with instructions to receive a Prize certificate at SpaWish.com. In the case of a Snapfish® Prize, the confirmed winner will be provided instructions respecting claiming the Prize, and the Prize must be claimed online by December 31, 2011. For any other Prize valued under $600, the Sponsor expects to complete Prize delivery to a Prize winner within 8-10 weeks thereafter. If the verification process (including verifying that the potential Prize winner has correctly answered the Skill-Testing Question) results in Prize forfeiture, the potential Prize winner will not receive the Prize, and the applicable Prize will not be awarded in the Game.
Claims for the following Prizes will follow the process just described:
Gift Card/Certificate Prizes:- $10 & $50 Gift Card for Gas. Each confirmed winner will receive a gift card valid for the purchase of gasoline up to the value of the Prize. The card is not redeemable for cash and has no expiration date. Card is subject to terms and conditions found on the card. Prize may be awarded as a cheque or bank card of equivalent value in Sponsor's sole discretion. Loss or destruction of a card is the sole responsibility of the Prize winner and any value on a card is not replaceable if the card is lost, stolen or destroyed.
- SpaWish® $20 & $200 Gift Certificate. Any SpaWish® Gift Certificate can be combined with additional SpaWish® Gift Certificates for available services and products. The certificate is not redeemable for cash and has no expiration date. Certificates are accepted at thousands of day spas and salons worldwide and at www.MySpaShop.com. The cost of and availability of services and products varies by location. Terms and conditions apply and can be found at www.SpaWish.com/info/terms.htm. Prize winners can also use a SpaWish® gift certificate to select product(s) at www.MySpaShop.com.
- Walmart® $5, $10, $50 & $500 Gift Cards. A Walmart gift card can be used for purchases at any Walmart Store in Canada. A Walmart gift card cannot be redeemed for cash except where required by law. Loss or destruction of a Walmart gift card is the sole responsibility of the Prize winner. Lost or stolen Walmart gift cards cannot be replaced and any value on a Walmart gift card is not replaceable if the Walmart gift card is lost, stolen or destroyed. Subject to terms and conditions found on the back of the Walmart gift card. The Walmart gift card must be activated no later than February 28, 2012.
- $50 McDonald's® Gift Cards. Treat this card like cash. This card may only be used for purchases at participating McDonald's restaurants in Canada. The card value cannot be refunded, redeemed for cash or replaced if the card is lost, stolen or destroyed. After a period of non-use a recurring administration fee may be deducted from the balance, unless prohibited by law. Use of this card constitutes acceptance of all card terms and conditions, which may be amended by McDonald's. For more information about McDonald's Gift Cards, go to www.McDonalds.ca.
- Snapfish® Digital Photo Prints. The Prize is twenty (20) digital photo prints (including standard shipping and handling costs), that a winner will receive by mail. A confirmed winner will receive a redemption code that he/she must use to redeem the Prize by December 31, 2011 at the Online Redemption Site.
- EA SPORTS™ Video Game. The Prize is an EA SPORTS™ NHL® 12 Video Game, ARV $59.99. Each winner who claims the Prize at the English version of the Online Redemption Site will receive a redemption code and instructions to complete the Prize redemption process at the EA Online store, where the winner will be required to provide the redemption code and shipping information for the Prize delivery. Each winner who claims the Prize at the French version of the Online Redemption Site will receive the Prize in the mail. The redemption code expires on December 31, 2011. The Prize may not be substituted, exchanged, sold or redeemed for cash or other goods or services.
- Kinect™ for Xbox® 360 Prize Pack. Prize comprises a 4GB Xbox 360® console, Kinect™ Sensor and Kinect Adventures game. Prize is subject to manufacturer's warranty.
- Claiming Prizes Valued at $600 or More: Claim In-Store Prizes: An In-Store potential winner (or his/her parent or legal guardian if potential winner is an eligible minor), must follow the instructions on the Game Stamp to begin the Prize claim process by November 21, 2011. A potential winner may go to the Online Redemption Site or use the toll-free number to provide his/her full name and contact information necessary to claim the Prize. The Redemption Center will send the Prize Claim Document, and other information, to the address provided by the potential Prize winner. The Prize Claim Document will include but not be limited to a declaration of eligibility, release of liability, a publicity release, the Skill-Testing Question, and the Sponsor will provide the potential Prize winner with such other documents as are required for a particular Prize (e.g., a trip Prize will require guest releases). A potential Prize winner will also be required to provide the original potential "Instant Win" Game Stamp or all of the original potential winning "Collect and Win" Game Stamps which form a potential Winning Combination, whichever is applicable. Claim Online Prizes: Unless otherwise specified in these Official Rules, a potential winner (or his/her parent or legal guardian if potential winner is an eligible minor), must follow the instructions and begin the Prize claim process by November 21, 2011. Upon receiving a potential winning message, click on "BEGIN REDEMPTION PROCESS" (or simply follow the instructions in the Prize email which the Sponsor will send to a potential Prize winner at the email address that potential Prize winner provided on his/her registration form). Online claims require a printer in order to print the Prize Claim Document for necessary signature(s).
Once a potential winner follows the instructions provided by the Sponsor to claim the applicable Prize, the original executed Prize Claim Document (including the potential winner's answer to the Skill-Testing Question which appears in the Prize Claim Document) and any other required documents must be sent to the Redemption Center by mail for actual receipt by the Redemption Center no later than December 5, 2011. The Redemption Center will review and verify those Prize Claim Materials. When the Redemption Center completes the Prize claim verification process, the Redemption Center will contact a Prize winner to initiate the Prize awarding process, or will notify a potential Prize winner that he/she will not be awarded the applicable Prize. If the Sponsor so elects, a potential Prize winner may be required to submit to, and by playing the Game agrees to fully cooperate with the Sponsor in conducting, a confidential background check to confirm that Participant's eligibility and compliance with the provisions of these Official Rules and to help ensure that the use of such Participant in advertising or publicity for the Game will not bring Sponsor or a Prize Partner into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Game or the Sponsor or on a Prize Partner as determined by Sponsor in its sole discretion.
The following Prizes will follow the process just described:
Merchandise Prizes $600 (or more)- EA SPORTS™ "Lifetime of Games". Prize consists of eight (8) EA SPORTS games each year for a term of fifty (50) years, each with an ARV of $60.00. A winner, at time of Prize claim, can elect to receive this Prize in the form of fifty (50) retail gift cards, each for $480 which the Prize winner can use at retail, OR, the winner of the Prize can elect to receive the Prize in the form of a lump sum check in the amount of $24,000.
- EA SPORTS™ Ultimate Game Room. Prize consists of a $2,000 bank card for winner's use to purchase items at winner's sole discretion. Winner will also receive two (2) video game rockers, two (2) autographed sports memorabilia selected in its sole discretion by the applicable Prize Partner, and redemption codes that the winner can use to select five (5) EA SPORTS video games. Bank card is subject to terms and conditions. Prize may not be substituted, exchanged, sold or redeemed for cash or other goods or services. No representation is made regarding the barter, trading or sale value of the memorabilia Prizes which can vary due to market fluctuations.
- Walmart® $1,000 & $5,000 Gift Cards. A Walmart Gift Card can be used for purchases at any Walmart Store in Canada. A Walmart gift card cannot be redeemed for cash except where required by law. Loss or destruction of a Walmart gift card is the sole responsibility of the Prize winner. Lost or stolen Walmart gift cards cannot be replaced and any value on a Walmart gift card is not replaceable if the Walmart gift card is lost, stolen or destroyed. Subject to terms and conditions found on the back of the Walmart gift card. A Walmart gift card must be activated no later than February 28, 2012.
**The Approximate Value for Vehicles: The Prize Vehicles (2012 Nissan® Z™ and 2012 LEAF™) (each a "Vehicle") have not yet been offered for sale in Canada as of the date of the finalization of these Official Rules. For that reason, the ARV which appears in these Official Rules with respect to those Vehicles is the Sponsor's estimate of the initial offering price for each of those Vehicles, with standard equipment at a dealership in the Toronto area, when they become available for sale in Canada.
Conditions for all Vehicle Prizes:
Vehicle will be delivered with standard equipment for make and model; any upgrades and options are at the sole expense of the Prize winner. Colour, package, factory options, and other vehicle Prize specifics to be determined by the Sponsor in its sole discretion and are subject to availability. The Sponsor does not make, nor in any manner is responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to a Prize vehicle including but not limited to its quality, fitness for purpose or mechanical condition. Vehicle will be delivered solely with the express limited warranties set out in the Vehicle's Owner's Guide, which warranties shall run for the term set out in the said Guide. The Prize winner must have and provide a valid driver's license in the Prize winner's Province/Territory of residence and proof of existing vehicle insurance coverage (comprehensive and/or liability as required by the law of the Prize winner's Province/Territory of residence) at time of vehicle delivery, and any other information as required by applicable laws. The Sponsor will arrange for vehicle to be made available for pickup by the Prize winner from the Nissan dealership nearest to the Prize winner's residence ("Dealership"). The Prize winner's personal transportation to the Dealership is the sole responsibility of the Prize winner. The Prize winner will be solely responsible for any applicable registration (including sales or like tax), license, title and insurance fees, and any expenses not listed herein related to receipt, possession, acceptance and use of the Prize. Any difference between the stated ARV and the actual value of the vehicle will not be awarded. The Sponsor in its sole discretion may elect to substitute a vehicle of the same or like make, model and style in the event of scarcity of the Prize vehicle as described above, or the Sponsor may elect in its sole discretion to provide the Prize winner with a cash substitution due to limited production or unavailability of the Prize vehicle for any other reason.- 2012 Nissan® LEAF™. One (1) Model year 2012 excluding tax, title, license and handling charges and one (1) home charging dock and an allowance for the cost of installation of the home charging dock (installation allowance not to exceed $5,000). Winner may be able to select choice of exterior colour. Vehicle includes standard equipment and any features and/or upgrades requested will be at winner's own expense. If the Prize vehicle or public charging station is not available in the Prize winner's geographical area for any reason at the time of Prize award (as determined by the Sponsor in its sole discretion), the Sponsor reserves the right to award a vehicle of comparable value. Failure to take delivery of the Vehicle within thirty (30) days of notice of availability will cause Prize forfeiture.
- 2012 Nissan® Z™. One (1) model year 2012 Coupe Touring Model with automatic transmission and standard equipment, excluding tax, title, license and handling charges. Winner will be able to select choice of exterior colour. Vehicle includes standard equipment and any features and/or upgrades requested will be at winner's own expense. If Vehicle is unavailable for any reason, Sponsor reserves the right to award a vehicle of comparable value. Failure to take delivery of the Vehicle within thirty (30) days of notice of availability will cause Prize forfeiture.
Conditions for All Trip Prizes. Any and all costs, fees, and expenses not expressly stated in the Prize description are the sole responsibility of the Prize winner including, without limitation, the cost of return transportation for a Prize winner and his/her guest(s) between the Prize winner's residence and the designated airport of departure. Any difference between the approximate retail value and the actual value will not be awarded. No insurance is provided as part of the Prize, and obtaining any insurance, such as but not limited to, travel insurance, health, accident or medical insurance, and property loss or damage insurance is the sole responsibility of the winner and/or the winner's guests. Travel and other arrangements will be determined by the Sponsor or the applicable Prize Partner. If the travel Prize winner is a Minor, winner's guest must be winner's parent/legal guardian; and if winner's guest is a minor in his/her Province/Territory of residence, that minor guest must be the Prize winner's child or the Prize winner must be the legal guardian of or have legal custody of that minor guest. Air travel will be provided by Delta Airlines, will be round trip (originate from and end at the same airport) coach class from an airport selected in its sole discretion by the Prize Partner. The travel Prize winner and guests must travel together on the same itinerary and are solely responsible for having [and bearing the cost of obtaining including any related notarization cost or costs] any required travel-related documents (including without limitation, valid government-issued photo ID and/or any required passport or visa and any requisite parental consent document or documents) prior to departure as well as fulfilling any/all travel and security requirements. The Sponsor or the applicable Prize Partner, as the case may be, reserves the right in its sole discretion to designate all flight/travel particulars and route or routes (as the case may be). Failure to complete the trip portion of the Prize (or any portion of the Prize) does not relieve the Prize winner of his/her tax obligations, if any, associated with winning the trip Prize. Flight schedules are subject to change without notice. Neither the Sponsor nor the applicable Prize Partner will be liable for any missed opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. The Prize winner may be required to provide a current valid major credit card at time of hotel check-in to cover the cost of incidentals and any and all costs, fees, and expenses not expressly stated in the Prize description. Restrictions and/or blackout dates may apply. Once a guest is determined, that guest cannot be changed without the express consent of the Sponsor, which may be withheld for any reason in the sole discretion of the Sponsor. Each winner (and each guest) agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Prize-related activity. Prize winners understand and agree that the Sponsor or the Prize Partner, as the case may be, has the right, in its sole discretion, to disqualify and remove a Prize winner or any guest from any activity at any time if that winner or guest's behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of the Sponsor and/or the Prize Partner, or otherwise violates the policies of the Sponsor and/or Prize Partner. The Prize winner is solely responsible for the behavior of his/her children and guests.
The ARV of each of these Prizes is calculated using Pearson International Airport in Toronto as an example for point of departure; the actual trip cost will vary with the actual point of departure (and destination) as well as with any fluctuations in air travel costs at the time a trip is booked. See Rule 6 for trip ARVs. See Rule 7E for Prize claim instructions, trip descriptions and an abbreviated summary of trip terms and conditions.- Beaches Resorts – The Luxury Included® Vacation. Each winner will receive a four (4) day/three (3) night Luxury Included® vacation for two (2) adults and two (2) children (who must be the children or legal wards of the winner or of the winner's adult guest) aged fifteen (15) years or under to a Beaches Resort located in Turks & Caicos or Jamaica; inclusive of round trip coach air travel on Delta Airlines, resort accommodations (one quad occupancy room), all meals (but not specialty on-premises meals, or off-premises dining), unlimited on-premise premium brand beverages, daily and nightly on-premise entertainment, all on-premise land and water sports including scuba diving (for certified divers), snorkeling, and airport transfers between the airport and Beaches Resort. Prize includes only those items listed and does not include, for example but not limited to: telephone calls, Red Lane® Spa treatments and services, specialty dining, tours and excursions, inter-island transportation, SCUBA certification courses, island departure taxes and purchases made at the Beaches Specialty Shops or spending money. Travel must be taken by December 5, 2012.
- EA SPORTS™ Fan Trip for Two (2). Prize comprises three (3) day/two (2) night trip for winner and one (1) guest to a championship or championship series game in the United States ("Championship Game") for which EA is authorized to provide a trip Prize. Delta Vacations will provide round trip coach air travel on Delta Airlines for two (2); two (2) nights accommodations (one (1) standard double occupancy room); and airport transfers in the destination city. EA will provide admission for winner and guest to the Championship Game and a total of $500 for meals and incidentals. Selection of the Game is based on availability and a winner will have the opportunity to select a Championship Game from a list of available Championship Games to be provided to winner. All available Championship Games will occur during 2012. Winner must travel on dates consistent with the dates of the Championship Game determined by EA and Delta Vacations. Restrictions may apply. Prize may not be substituted, exchanged, sold or redeemed for cash or other goods or services.
- 2012 McDonald's® All-American® High School Basketball Games Trip. A three (3) day/two (2) night trip for winner and up to three (3) guests to the 2012 McDonald's® All-American® Games ("Basketball Games") in Chicago, Illinois, United States of America which is scheduled to take place on Wednesday, March 28, 2012. Prize comprises round trip coach air travel on Delta Airlines for winner and up to three guests; two (2) nights' accommodations (two (2) standard double occupancy rooms or one (1) quad occupancy room, as determined by the Sponsor in its sole discretion); airport transfers in Chicago, admission for winner and guests to the Basketball Games and a total of $500 for meals and incidentals. Air travel, hotel accommodations and airport transfers will be arranged by Delta Vacations. Details of the Games can be found at McDonaldsallamerican.com.
- Trip to the London 2012 Olympic Games. Prize is comprises four (4) day/three (3) night trip for winner and up to three (3) guests to London between July 26, 2012 and August 12, 2012 to attend two (2) London 2012 Olympic Games events which will be selected by the Sponsor in its sole discretion. This Prize trip comprises round trip coach air travel for four (4); three (3) nights accommodations (one (1) quad occupancy or two (2) standard double occupancy rooms, as determined by the Sponsor in its sole discretion); airport transfers in London on the Heathrow Express; four (4) tickets for each of two (2) events; and $1,000 total for meals and incidentals. Dates and events will be based on availability and determined by the Sponsor in its sole discretion. Any winner must be available to travel during the above noted dates.
- Food Prizes. Potential winning "Instant Win" Game Stamps for McDonald's food items that are Food Prizes in the Game may be redeemed only in-store (not at or through a Drive-Thru) at any participating McDonald's restaurant in Canada. A Participant should inform a McDonald's restaurant counter person that he/she wishes to redeem a potential winning "Instant Win" Game Stamp for a Food Prize. The Participant should present the potential winning "Instant Win" Game Stamp for the Food Prize for redemption before the food order is placed. The counter person will provide the Participant with a restaurant level food Prize redemption form (a "Food Redemption Form"), which contains a Skill-Testing Question. The Participant then should complete the Food Redemption Form legibly, and in full, including his/her signature and correct answer to the Skill-Testing Question (arrived at independently by the Participant without assistance of any kind, whether mechanical, electronic or other), which is printed on the Food Redemption Form. Then, the Participant should present the following to the counter person for verification and redemption for the applicable Food Prize: his/her completed Food Redemption Form (including his/her correct answer to the Skill-Testing Question) and his/her potential winning "Instant Win" Game Stamp, which he/she must affix to the Food Redemption Form in the space indicated, with his/her initials signed in ink across the face of his/her potential winning "Instant Win" Game Stamp. "Instant Win" Game Stamps for Food Prizes may be redeemed only during the hours the menu item is served and only on a future visit. "Instant Win" Game Stamps for Food Prizes are not valid in combination with any other offer or discount. Only one (1) Food Prize redemption is permitted per Participant per visit. All visits to the same restaurant within a two-hour period are deemed to constitute a single visit. Participating McDonald's restaurants reserve the right to substitute a menu item of equivalent or greater retail value for the Food Prize specified. Some participating McDonald's restaurants may run out of their supply of specially marked packaging containing Game Pieces before the Game officially ends, but they will continue to honour winning Game Stamps for Food Prizes that are redeemed in accordance with these Official Rules. The deadline for claiming a Food Prize is November 14, 2011.
- GENERAL AND PRIZE RESTRICTIONS. EXCEPT WHERE OTHERWISE PROVIDED IN THESE OFFICIAL RULES, PRIZES WHICH ARE NOT CLAIMED OR WHICH ARE FORFEITED WILL NOT BE AWARDED IN THE GAME. No cash alternative or substitution of any non-monetary Prize will be provided (other than as may be expressly provided in the Prize descriptions in these Official Rules), except that the Sponsor, in its sole discretion, reserves the right to substitute a Prize of equal or greater value if any non-monetary Prize cannot be awarded as described due to unavailability or for any other reason. Prizes will be delivered only to an address in Canada. Any income or other taxes (including, without limitation, federal, Provincial/Territorial, and local income taxes) on or connected with any Prize, and the reporting consequences thereof, are solely the responsibility of the Prize winners. If required by law, the Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any taxes due. Any expenses which are applicable to any Prize, and which are not expressly included in the description of that Prize in these Official Rules, are the sole responsibility of the Winner of that Prize. If a potential Prize Winner cannot accept a Prize as described in these Official Rules, then that Prize will be forfeited in its entirety and will not be awarded in the Game. If a winner of a Prize is a Minor in his/her Province/Territory of residence, the applicable Prize will be awarded in the name of, or to, that Winner's parent/legal guardian, who must execute all documents and agree to all obligations and undertakings of a potential (or actual) Prize Winner, both on behalf of himself/herself and the Minor, or the Prize will be forfeited in its entirety and will not be awarded in the Game.
Please note that shipping/courier companies may be unable to deliver to a Post Office Box. Participants must return their completed Prize Claim Materials using Canadian Postal Service registered mail or, if provided, using the pre-paid envelope provided in the redemption package with the Prize Claim Document. The mailing of Prize Claim Materials, or the use of the pre-paid envelope provided in the redemption package, does NOT constitute proof of actual delivery of the Prize Claim Materials to the Redemption Center and does NOT constitute proof of actual receipt by the Redemption Center of the Prize Claim Materials. When Participants send Prize Claim Materials by registered mail, or in the pre-paid envelope provided in the redemption package, as the case may be, in accordance with the requirements contained in this paragraph of Rule 8, it is strongly recommended that they obtain insurance for the Prize Claim Materials. Prior to mailing Prize Claim Materials (or, if applicable, returning Prize Claim Materials using the pre-paid envelope provided in the redemption package), Participants should photocopy for their records all Prize Claim Materials being submitted, including without limitation the signed and completed Prize Claim Document and any potential winning Game Stamp(s). PARTICIPANTS SHOULD NOT SHOW OR GIVE ANY "INSTANT WIN" GAME STAMP, ANY POTENTIAL WINNING COMBINATION OF GAME STAMPS, ANY GAME MATERIALS AND/OR ANY PRIZE CLAIM DOCUMENT TO ANY McDONALD'S EMPLOYEE. McDONALD'S EMPLOYEES CAN ONLY VERIFY AND REDEEM "INSTANT WIN" GAME STAMPS FOR FOOD PRIZES. - VERIFICATION. "Instant Win" Game Stamps for Food Prizes are subject to verification at a participating McDonald's restaurant. All other Game Stamps and Prize Claim Documents are subject to verification at the Redemption Center. Game Stamps are null and void and will be rejected if not obtained through authorized, legitimate channels. Legitimate channels do not include purchasing Game Stamps online or at live auctions. If any part of any Game Stamp is counterfeited, or if any Game Stamp comes from other games or promotions, or if any part of any Game Stamp is illegible, mutilated, eaten, damaged or tampered with in any way, or if any Game Stamp contains or reflects printing, typographical, mechanical or other errors or omissions, the Game Stamp will be rejected and will be deemed void and invalid. Each Participant acknowledges and agrees that the decisions of the Sponsor and the Redemption Center shall be final, binding and conclusive in all matters relating to the Game, including, without limitation, determinations regarding the validity, state or status of Registrations, entries, attempted entries, and Game Stamps submitted for verification. Only Game Stamps with 2011 Game artwork will be accepted for verification. Any person attempting in any way to forge or alter any Game Stamps or to create materials such as screen shots in an apparent attempt to defraud or mislead the Sponsor in any way in connection with this Game will be prosecuted to the fullest extent permitted under the law. In the event of a dispute as to the identity of a Participant, the online entry in question will be deemed to have been submitted by the authorized account holder of the email account from which it was sent. The "authorized account holder" shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning email addresses for the domain associated with the submitted email address. A potential winning Participant may be requested to provide the Sponsor with proof that he/she is the authorized account holder of the email address associated with the potential winning entry. If a dispute cannot be resolved to the Sponsor's satisfaction, the Code submission and/or Sweepstakes entry will be deemed ineligible. Subject to the provisions of these Official Rules, if any potential Prize Winner (or in the case of a Minor, such Minor's parent or legal guardian) fails or refuses to properly sign and return the Prize Claim Materials by the deadline for their receipt by the Sponsor or the Redemption Center or if the Prize is declined or if the Prize Claim Document is returned as unclaimed or undeliverable to any potential Prize Winner or if the potential Prize Winner is ineligible or does not correctly answer or fails or refuses to answer the Skill-Testing Question, such potential Prize winner will be disqualified, in which case he/she will forfeit his/her Prize and will have no further claim against the Sponsor or any other person in respect to the Prize or the Game and the Prize to which he/she otherwise might have been entitled will not be awarded in the Game. If a Prize Winner makes any false statement in any document related to the Game, the Winner will be required to promptly return to the Sponsor upon demand the Prize(s) or, at the Sponsor's option, the cash equivalent of the Prize(s) based on the ARV as stated in these Official Rules.
- DISCLAIMER OF WARRANTIES. Subject to the provisions of this Rule 10, the Releasees (see Rule 11) make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any Prize offered or awarded in the Game. SUBJECT TO THE PROVISIONS OF THIS RULE 10, AND WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE RELEASEES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT. This disclaimer of warranties does not apply to a Releasee with respect to a Prize supplied for the Game by such Releasee and the warranty of such a Prize will be the warranty, if any, provided by the applicable Releasee for the Prize it supplies.
- GENERAL RELEASE AND CONDITIONS OF PARTICIPATION. Participants assume all risk of loss, damage, destruction, delay and misdirection of Prize Claim Materials and are advised to obtain insurance. The Sponsor is not responsible for colour discrepancies in or in relation to any Game Stamp(s). The Sponsor is not responsible for illegible, misdirected, late, lost, damaged, stolen, or any postage-due submissions of Prize Claim Materials (or for any submissions which are sent on a ‘collect' basis), which may be judged void; for any damage to a Participant's computer system or wireless device which is occasioned by accessing the Official Website, by participating in the Online Game, or by redeeming or attempting to redeem an Online Prize; for lost, interrupted, inaccessible, incompatible or unavailable networks, servers, satellites, Internet Service Providers, wireless carriers, web sites (including the Official Website), or other connection; for availability or accessibility problems arising in connection with or over the course of the Game; for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions, or hardware or software malfunctions, failures or difficulties; for any technical malfunctions, failures, or difficulties, printing errors or omissions, clerical, typographical or other error(s) or omissions in any materials connected to the Game including, without limitation, in any Game Stamps, Game Pieces, Codes, Prize Claim Document, registration form, iteration of these Official Rules, communication whether written or oral, the offering or announcement of any Prize or in any Prize notification or email or letter; for any errors or omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, or technical in nature; or, for the incorrect or inaccurate capture of information, or the failure to capture any information. Game Materials and Prize Claim Materials submitted become the property of the Sponsor and will not be returned. By participating in the Game and redeeming a Prize, each Prize Winner (or, if applicable, each Minor Winner's parent or legal guardian) hereby releases and agrees to hold the Game Entities, the Prize Partners and their respective parent companies, subsidiary/subsidiaries, affiliated company/companies and service agencies, Nissan Canada Inc., Microsoft Canada Inc., Unique Vacations (Canada) Inc., Electronic Arts (EA) Canada Inc., Hewlett-Packard (Canada) Co. and the Redemption Center (collectively the "Releasees") and every director, officer, employee, agent or franchise owner of any one or more of the Releasees and their respective divisions, parents, subsidiaries or affiliated companies, advertising and promotion agencies, representatives, service agencies, or independent contractors harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, death, bodily injury, and property or other damage or loss, due in whole or in part, directly or indirectly, to participation in the Game or in any Game-related activity, or participation in any Prize-related activity or activities, or due in whole or part to the receipt, use or misuse of any Prize. Participants waive the right to assert as a cost of winning any Prize, any and all costs of verification and redemption or travel to redeem said Prize and any liability and publicity which might arise from redeeming or seeking to redeem said Prize. By submitting Prize Claim Materials, except where legally prohibited, each verified Winner (or each Minor Winner's parent or legal guardian) hereby agrees and grants the Releasees the right, but not the obligation, to use his/her name, voice, and likeness, along with his/her address (city/town and Province/Territory) and any statements made by or attributed to such Winner in any and all media (including the Internet), now known or hereafter devised, in perpetuity and throughout the universe for advertising and promotional purposes in connection with the Game and other promotions without further notice, review, approval or compensation, and releases the Releasees and all directors, officers, employees, agents and franchise owners of one or more of the Releasees and the Releasees' respective divisions, parents, subsidiaries or affiliated companies, advertising and promotion agencies, representatives, service agencies, or independent contractors from any liability with respect thereto.
- MISCELLANEOUS.
- Disqualification. It is each Participant's responsibility to ensure that he/she has complied in full with all of the conditions and requirements contained in these Official Rules The Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or with the operation of the Game, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Game, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
- Force Majeure/Printing and Production Errors or Omissions. Subject to any governmental approval which may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Game, in whole or in part, or modify, suspend or extend the Game in any way, if it determines, in its sole discretion, that the Game is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, glitches, or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Game. In the event the Sponsor is impeded or prevented from continuing with the Game as planned or intended by any event beyond its control, including, but not limited to fire, flood, natural or manmade epidemic or health hazard or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, Provincial, or local government law, order, or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor's control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Game. Subject to the provisions of these Official Rules, only the type and quantity of Prizes described in these Official Rules will be awarded in the Game. The sole responsibility and liability for any irregular Game Code, Game Stamp or Online Game Play caused by the Sponsor is replacement with another randomly selected Code, or Game Stamp while supplies last, as solely determined by Sponsor. Replacement shall be the sole and exclusive remedy under such circumstances. If, due to printing or production errors or omissions or for any other reason whatever, the number of potential Prize Winners coming forward seeking to claim Prizes exceeds the number of each type of Prize as set out in these Official Rules, the Prize Winners, or remaining Prize Winners, as the case may be, of the number of Prizes described in these Official Rules as being available in the Prize category in question, in the sole discretion of Sponsor, may be selected in a random drawing from among all persons making purportedly valid claims for such Prize(s). Inclusion in such drawing shall be each Participant's sole and exclusive remedy under such circumstances.
- Invalidity. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.
- Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Game shall be governed by and construed and interpreted in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws. All Participants, the Sponsor, and all other parties hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Game or these Official Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.
- Language or Other Discrepancy. In the event there is a discrepancy or inconsistency between the English language version and the French language version of these Official Rules or of any Game Materials or Prize Claim Documents, the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Game Materials or Prize Claim Documents, product packaging or advertising or other publicity or materials or communications concerning or related to the Game and the provisions contained in these Official Rules, the provisions in these Official Rules shall prevail, govern and control.
- Quebec Residents. RESIDENTS OF THE PROVINCE OF QUEBEC MAY SUBMIT ANY LITIGATION RESPECTING THE CONDUCT OF THIS PUBLICITY CONTEST TO THE RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX FOR A RULING. ANY LITIGATION RESPECTING THE AWARDING OF A PRIZE MAY BE SUBMITTED TO THE RÉGIE ONLY FOR THE PURPOSE OF HELPING THE PARTIES REACH A SETTLEMENT.
- Privacy. Information collected in connection with this Game may be shared with Sponsor's promotional partners to the extent necessary to fulfill Prizes. Each Prize Partner has its own online privacy policy that differs from the privacy policy applicable to the Official Website, and Sponsor encourages Participants to review the privacy policy of any other website they may visit. Except as otherwise contemplated in these Official rules, information collected by Sponsor in connection with Game will be used by Sponsor in accordance with the Online privacy policy posted on the Official Website.
- Official Rules. These Official Rules will be available at participating McDonald's restaurants and online at www.mcdonalds.ca and at www.PlayatMcD.ca until December 31, 2011. To receive a copy of the Official Rules, mail a postage-paid, self-addressed stamped envelope to McDonald's Redemption Center: 2011 McDonald's MONOPOLY Game – Rules Request, P.O. Box 361, Station E, Toronto, Ontario, Canada, M6H 4E3. All requests must be received by December 31, 2011. Limit one (1) request per outer envelope.
